The manufactured Housing industry is evolving.  As a result of the many changes occurring within the industry, it is important that owners and leaders understand the importance of risk management. Proper risk management can provide tremendous cost savings, while those entities not implementing a risk management program will find themselves uncompetitive and at risk of losing all they worked to create.

In his article, “The Urbanist Case for Trailer Parks,” writer Nolan Gray makes a very good case about the importance of manufactured housing in helping solve the nation’s demand for high quality affordable housing.

Here is the key quote:

The housing crisis isn’t a technological problem—it’s a legal problem, one built upon the same prejudices that shape so many other disparities in American urban planning. We know how to build and distribute enough affordable housing to shelter the 554,000 homeless Americans that currently need it, desperately. But if we don’t allow more manufactured housing to legally be built, this technology may as well not exist.

MH Work Continues over the Summer

Summer is generally a slower time in the Richmond region as families head out for vacation (or to the Rivah!). But, the work on issues related to manufactured housing goes on.

Housing Commission Begins Consideration of MH Legislation
The Virginia Housing Commission Neighborhood Transtions Workgroup began working on several issues directly related to manufactured home communities. One is legislation that would create a first right of refusal for park residents when an owner decides to sell their community, place notification requirements on owners who decide to sell, and require owners to consider offers from tenants to purchase the community and negotiate in good faith when such offers are made. Another would significantly raise the amount a tenant could collect from a landlord who violated provisions of the Virginia Manufactured Home Lot Rental Act, but not place a similar burden on a resident who violates the Act.

At the workgroup meeting, members discussed an increased penalty for the two specific “slumlord/bad actor” practices that tenant advocates say they have observed: park owners not providing written leases and/or doing month to month leases in violation of the Act, both of which are specific things. All of these issues will be back on the agenda in September.

The Housing Commission will also be looking at legislation dealing with things like rent-to-own and lease option contracts as well as hoarding. You can click here to see a full list of items on the Housing Commission agenda this summer and fall.

Work to Begin on Source of Income Legislation
During August, a workgroup will begin discussions on legislation that would add “source of income” to the Virginia Fair Housing Act. In short, this would create a situation where landlords who make a business decision not to participate in Section 8 could be the subject of fair housing complaints. In other words, landlords would be forced to accept vouchers and become subject to all of the regulations associated with Section 8.

Lieutenant Governor Holds Eviction Rountables
Lieutenant Governor Justin Fairfax recently held three roundtables (Richmond, Newport News, and Chesapeke) on the evictions issue. They included a wide range of stakeholders and very open, balanced discussions about the challenges, opportunities, and concerns of both landlords and tenants. President Trump Signs MH Relief Into Law!

President Trump has signed S. 2155 , the “Economic Growth, Regulatory Relief, and Consumer Protection Act,” into law! This law contains a provision clarifying that persons selling manufactured homes will not be considered “loan originators” for simply helping a customer during the loan process, provided that they are not compensated for the loan. The upshot is that this modest change will make it much easier for retailers (both in-park and street retailers) to work with customers during the purchasing process.

Congress Passes Important Reform

The United States House of Representatives has approved S. 2155 , the “Economic Growth, Regulatory Relief, and Consumer Protection Act.” Among is provisions is a commonsense reform clarifying that persons selling manufactured homes will not be considered “loan originators” for simply helping a customer during the loan process, provided that they are not compensated for the loan.

This legislation has already been approved by the US Senate, and it now heads to President Trump for his signature.

This proposal would restrict rights of MHC owners and decrease housing choices for working families….

The [San Juan Capistrano] City Council could be asked on Aug. 15 to adopt an ordinance designed to keep age restrictions permanently intact at four senior citizen mobile home parks in town.

Boulder buys mobile home park to provide affordable housing

BOULDER, Colo. — City leaders in Boulder are working to stay ahead of soaring rent by paving the way for more affordable housing options.

Part of that effort has included using taxpayer dollars to buy a mobile home park.

Share Your Thoughts with HUD

If so, here is your chance to share your thoughts from HUD — and they want to hear from you!!

HUD has reached out to the public to solicit your input on regulations that affect you:

“As required by Executive Order 13777, HUD is in the process of establishing a Regulatory Task Force charged with identifying agency regulations that should be repealed, replaced, or modified. As part of this review, HUD invites public comments to assist in identifying existing regulations that may be outdated, ineffective, or excessively burdensome. HUD’s goal in conducting the review is to make the Department’s regulations more effective and less burdensome in achieving HUD’s mission to create strong, sustainable, inclusive communities, and quality affordable homes for all.”

The Manufactured Housing Institute has has a “click-and send” letter that you can personalize and share your views with HUD. Comments should be submitted no later than June 14, 2017.
